SOUND OFF --- Comments are sought on a variety of proposals affecting the practice of law: MCLE rules revisions, client credit card payments, client fee arbitration forms, guidelines for fee arbitration programs, resigning from the State Bar and open meeting policies of the Board of Governors.

NONPROFIT LEGAL PRACTICE --- The State Bar is conducting a study of nonprofit legal practice in California, responding to the Supreme Court's directive in Frye v. Tenderloin Housing Clinic Inc.

ANNUAL ATTORNEY DUES --- Annual fee statements were mailed Nov. 15. Bar dues not postmarked or paid online by Feb. 1 will be considered late and a penalty will attach on Feb. 2.

MALPRACTICE AVOIDANCE ---Seminars aimed at educating attorneys about avoiding malpractice claims will be held in January in Los Angeles, San Francisco and San Jose. Offered at a discounted cost, four credits in ethics and two self-study credits in the elimination of bias, alcohol and substance abuse are available. (Due to an editing error, the seminars were incorrectly listed as free in the December California Bar Journal).

NEW COUNCIL APPLICATIONS --- Applications are open for membership on a new council devoted to increasing diversity in the legal profession.

In August 2006 the Judicial Council adopted an updated Trial Court Capital Outlay Plan that includes 181 new construction, major renovation, and expansion projects estimated to cost $9 billion (January 2006 dollars) and directed staff of the Administrative Office of the Courts (AOC) to submit, as part of the fiscal year 2007–2008 budget process, funding requests for nine new trial court facilities.

ANNUAL MEETING WEEK BEGINS --- Online registration closes on Oct. 2 for the State Bar's Annual Meeting in Monterey, Oct. 5-8, but onsite registration will be available. Attorneys have the opportunity to earn up to 20 hours of MCLE credit on topics ranging from elder law to the hottest issues in cyberspace.

COMMENTS SOUGHT ON ATTORNEY RULES --- The public is invited to speak at an Oct. 7 hearing of the State Bar's Rules Revision Commission in Monterey on proposed changes to the California Rules of Professional Conduct that govern all lawyers in the state.

New Judgeships Number Slashed

About Judgeships

Hello Everyone:

The Press Enterprise tells us this morning (8-18-06) ["Bill Slashes New Judgeships in Half" read the article here] that Fabian Nunez, our Assembly Speaker, has cut the new judgeships from 50 back to 25. Even the additional 100 (50-50) as I have been explaining, is in jeopardy. It you have any influence, at all, with anyone up there, please call and write them TODAY.

If any potentially good news remains is that San Bernardino, per the Judicial Council formula, was to receive 5 of the first 25 judgeship and the formula only gave San Bernardino two or three more judgeships with the next 25.

Of course the number was originally 150, 50 per year over 3 years.

Twin Peaks Court to be Closed Oct 2, 2006

Pursuant to California Rules of Court 6.620, the Superior Court of California, County of
San Bernardino hereby gives notice that it will cease hearing cases in its Twin Peaks
facility effective October 2, 2006.
The matters currently being heard in the Twin Peaks facility will be heard in the San
Bernardino (Central) Region. The judicial officer currently hearing cases in Twin Peaks
on Monday will hold sessions in Big Bear instead.
The San Bernardino clerk’s office is open Monday through Friday, 8am to 4pm, except
on court holidays.
The decision to cease hearing cases in Twin Peaks was made by the Presiding Judge
Larry W. Allen.
During the public comment period, the court received over 100 written and e-mail
responses. All the responses received by the court objected to the reduction of services
provided by the Twin Peaks Court.
The four reasons mentioned most frequently were:
1) Having deputies appear in court in San Bernardino would reduce the amount of time
they were on patrol, creating a public safety issue;
2) Driving to San Bernardino was a burden and an expense on mountain residents,
particularly during the winter;
3) The court provided a sense of identity for the mountain community, which was
deserving of a certain level of services from all governmental agencies and;
4) Without the convenience of a local court, many legal matters that might otherwise be
pursued, such as small claims actions, would go unresolved by the courts.
There are no written factual materials that have been specifically gathered or prepared for
review at the time of making the decision to cease operations at the Twin Peaks
Courthouse.

The Legislature will have to do better than the latest compromise budget plan if the state hopes to have an effective court system. California needs more than 350 new judges, but the Legislature can't agree to put even 50 new judgeships in the budget.

Gov. Schwarzenegger last month included $5.5 million in his 2006-07 budget proposal to start adding 150 new judges over three years. The California Judicial Council, which oversees the state's courts, says 150 new positions is less than half the actual need, but budget realities dictated restraint.

Yet the Legislative conference committee that crafted a compromise budget earlier this month cut that number in half, approving only 25 new judges statewide with no commitment to adding more judges later.

California has many needs, certainly, but underfunding the necessary work of the courts is a false frugality. The state's court system faces an increasing caseload as the population expands, which leads to long waits for hearings, limited time for judgments and a deterioration in the quality of justice.

Inland residents especially should recognize the necessity of additional judges. State numbers show that Riverside and San Bernardino county judges have some of the highest caseloads per judge in the state, surpassed only by small, rural counties with few judges. Riverside County has halted civil trials to handle a backlog of criminal cases twice in the past two years. The Judicial Council's three-year plan asked the state to add 19 judges to Riverside County and 23 to San Bernardino County.

Such numbers should be compelling, even to legislative committees. California cannot afford to let justice in this state crumble from willful neglect.

Crumbling Courthouses Fall Through the Budgetary Cracks
Cash-Poor Counties Can't Afford to Properly Maintain Court Facilities

LOS ANGELES - Wags around the Stanley Mosk Courthouse in downtown Los Angeles are quick to point out advantages of the building's top-floor cafeteria. The food may not be the tastiest, but if the Big One pancakes the building, those diners will be on top of the pile.
At 48, the Mosk courthouse is nearing the end of its life-cycle, as are most courthouses built in the 1960s and earlier in Los Angeles County and the rest of the state.
California counties are responsible for maintaining the courthouses until they are transferred to the state, a switch that was scheduled to begin in 2004 under laws intended to create a unified state court system.
And therein lies the rub.
The state isn't all that anxious to take over dilapidated buildings, and cash-strapped counties don't have the money to pay for repairs.
Counties ask, "'Why should we dump a bunch of money into those buildings and then give them to you,'" facilities administrator John Van Whervin said. "That's where the counties are coming from."
Only six county courthouses in the state have been transferred so far.
As rickety as it is, the Mosk courthouse is safe to occupy, county officials said. Some other county court buildings "are not going to do as well as others" in a quake, Van Whervin said.
But earthquakes are just one throb in Van Whervin's maintenance headaches.
"There are significant mechanical issues that cause us grief," he said.
In buildings so old, things break. Tiles fall. Pipes burst. Elevators stall. Heating and cooling units break down.
Those things breaking would cost up to $50 million a year to repair, more than three times the $15 million the county allocates each year for courthouse upkeep. That $50 million is simply beyond the county's reach, Van Whervin said.
And it is not likely the county would be willing to spend the money anyway because the courthouses are scheduled to be transferred to state control.
Until the transfers, originally scheduled to be completed next June, take place, county governments must scramble to keep court facilities functioning. Los Angeles County, with 51 court buildings, has some of the most dilapidated.
The most flagrant example is the Long Beach courthouse, a money hole whose advanced decrepitude is near legendary among attorneys who must work there.
The escalators clank and groan loudly before they regularly seize up and stop moving.
"You hear that," former Supervising Judge Bradford Andrews asked during a recent tour. "That's metal-on-metal. They're on the verge of breaking down again."
The elevators fail 8 percent to 12 percent of the time, Andrews estimated. The one carrying suspects to courtrooms goes out often, and when it does, defendants have to use the judges' elevator.

Impromptu cyclone fencing runs from the edge of a loading dock where sheriffs' department buses drop off suspects. They are held there until being loaded into the judges' elevator.
That elevator is not secured like the one built to transport defendants, so "they have to scramble all the deputies to post a deputy on each floor," Andrews said.
The courthouse plumbing breaks down, chunks of ceiling have fallen in many courtrooms and the walls are scarred with gaping holes. Earthquakes have separated the east wing from the west, creating a six-inch gap bridged with metal plates on each floor.
"When it rains, it rains from the roof to the basement," Andrews said.
If a magnitude 4.5 quake or greater strikes a nearby fault, the place would fall down before those inside could safely evacuate, Andrews said.
The California Department of General Services developed a seismic risk factor scale, rating buildings 1 through 7, with 1 being safest. State law mandating the transfer of courthouses requires that buildings have a rating of 4 or better.
The Long Beach courthouse is no where near that standard. A $12 million retrofit now under way will keep it standing long enough for occupants to evacuate, but using the building again after such a temblor would be unlikely, Andrews said.
Patching Long Beach's walls, overhauling the elevators and bringing the building up to seismic code standards would cost between $80 million and $120 million, Van Whervin said.

Kim Davis, the director of facilities for the state Administrative Office of the Courts, said two-thirds of the state's court facilities would need an upgrade to meet a 4 or better seismic risk factor, the transfer standard.
A confidential state report obtained by the Daily Journal showed 46 of Los Angeles County's 51 court facilities have a seismic risk level of 5.
But there is no need to panic, Van Whervin said.
"Just because a building does not meet the 1988 seismic code doesn't mean it's unsafe," he said.
Davis agreed. "It's different from being not suitable for occupancy," she said. "They are not more structurally unsound than other buildings the same age."
Robert Emerson, assistant director of the Office of Court Construction and Management, said, "An awful lot of state buildings are level five."
Legislators are considering approaches to make the transfers more practical, adding flexibility to requirements in laws now on the books. No bills have been introduced yet, but discussions have centered on seismic ratings, Davis said.
Legislators might also adjust what is called the court facilities payment. Counties may be transferring the courthouses, but they will still shoulder some costs under such an adjustment. The plan is to calculate what the counties have been paying for upkeep and require them to keep paying that amount to the state.

But money remains an issue. The California Office of the Courts' 20-year master plan estimated that it would cost $9.8 billion to maintain and expand California's courts, $2 billion in Los Angeles County alone.
State Sen. Joe Dunn, D-Garden Grove, who chairs the State Senate Judiciary Committee and has championed more funding for the courts, was among those who had hoped the $9.8 billion would have been part of Gov. Arnold Schwarzenegger's proposed public works bond. But the initiative never made it out of the Legislature.
Dunn bluntly assessed the possibility of getting money for courts now.
"My optimism for $9 billion is zero," Dunn said. "It's not because of hostility to the courts. Courts just don't rate high on the priority scale."
Dunn and Andrews said a bond measure is the only way to save the crumbling courts. But the state Judicial Council can't get into the political process and campaign for such a bond, Dunn said. The State Bar Association will have to play that role.
"The bar itself," he said, "is going to have to step up and become the voice for the court system."
