As Jurors Turn to Web, Mistrials Are Popping Up

Last week, a juror in a big federal drug trial in Florida admitted to the judge that he had been doing research on the case on the Internet, directly violating the judge’s instructions and centuries of legal rules. But when the judge questioned the rest of the jury,he got an even bigger shock.

California Rules to Amend Inaccessible ESI

Proposed electronic discovery rules before the California Senate's Committee on Rules alter the treatment of "inaccessible" ESI. Backup tapes, once deemed inaccessible, may enter the realm of accessible data.

The State Bar of California e-briefs

BOARD ELECTIONS --- April 1 is the deadline to submit nomination petitions for five openings on the Board of Governors.

ACCESS TO JUSTICE AWARD --- May 1 is the deadline to nominate a California judge for the 2009 Benjamin Aranda III Access to Justice Award.

MAY ETHICS SYMPOSIUM --- The 13th Annual Statewide Ethics Symposium will be held on Saturday, May 2, at the University of San Diego School of Law.

APRIL COMMENTS --- During the month of April, the State Bar is seeking public comment on a number of proposals regarding:

  • Reappointment of the Chief Trial Counsel
  • Limited legal services programs
  • Disqualification of State Bar Court judges
  • Limited scope representation
  • State Bar committee meetings
  • Fee arbitration rules

IN THESE TIMES --- Attorneys dealing with stress, burnout, substance abuse and other issues can take advantage of resources offered by the State Bar’s Lawyer Assistance Program. LAP offers services such as individual counseling, referral assistance, consultations for rehabilitation and private peer support groups.
